These Terms apply to your access to, and use of, all or part of any website or mobile application of Splashes Wash Lodge Inc., including the Splashes mobile app.

In the event there is any conflict or inconsistency between these Terms and any other terms of use that appear on the Sites, these Terms will govern. However, if you navigate away from the Sites to a third-party site, you may be subject to alternative terms and conditions of use, as may be specified on such site, which will govern your use of that site.

While we make reasonable efforts to provide accurate and timely information about Splashes Wash Lodge Inc. on the Sites, you should not assume that the information is always up to date or that the Sites contain all the relevant information available about Splashes.

You agree that we may provide notices, disclosures and amendments to these Terms by electronic means, including by changing these Terms by posting revisions on the Sites.

Privacy

Please read the Privacy Policy carefully to understand how Splashes collects, uses and discloses personally identifiable information from its users. By accessing or using the Sites, you consent to all actions that we take with respect to your data consistent with our Privacy Policy.

Email Communications

If a User signs up for a Splashes Newsletter, the User may choose to opt in to receive promotional email communications from Splashes (“Email Communications”). The User may, at any time, opt out of receiving Email Communications from Splashes by unsubscribing to the newsletter in the email sent via info@splashes.ca.

Splashes Wash Lodge Inc. Messaging Terms & Conditions

When you sign up to receive text messages from Splashes, you agree to receive recurring automated marketing and informational text (e.g., SMS and MMS) messages from Splashes Wash Lodge Inc., including text messages that may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Msg & data rates may apply.

Message frequency will vary. Splashes Wash Lodge Inc. reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. Splashes also reserves the right to change the short code or phone number from which messages are sent, and we will notify you when we do.

Not all mobile devices or handsets may be supported, and our messages may not be deliverable in all areas. Splashes Wash Lodge Inc., its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

Cancellation

Text the keyword STOP to our short code at any time to stop receiving text messages from Splashes Wash Lodge. After texting STOP to our short code, you will receive one additional message confirming that your request to withdraw your consent to receive text messages from Splashes Wash Lodge has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword commands, and agree that Splashes Wash Lodge and its service providers will have no liability for failing to honour requests to our text message platform that do not include the STOP keywords. 

If you unsubscribe from one of our text message programs, you may continue to receive text messages from Splashes Wash Lodge through any other programs you have joined until you separately unsubscribe from those programs. You may also continue to receive other electronic communications from Splashes Wash Lodge, such as transactional text communications.

Mobile Phone Number Change

In the event that you change or deactivate your mobile phone number, you agree to notify Splashes Wash Lodge via the email info@splashes.ca. 

Changes to Messaging Terms

We reserve the right to terminate or change our messaging program at any time. Subject to applicable law, we also reserve the right to change these Messaging Terms at any time and such changes will be effective immediately upon posting and your continued enrolment following such changes shall constitute your acceptance of such changes.

Splashes App Refund Policy

Wallet Reloads

Wallet reloads can be refunded to the original payment method within 30 days of purchase. The refund will be processed within 5-10 business days. Partially used balances cannot be refunded. - If you received bonus credits upon reloading your wallet, after receiving a full refund, the respective bonus credit earned will be removed from your account.

Single Wash Purchases

If you are unhappy with the service provided, we are happy to redo the service for you. If a rewash is not possible, a refund to the original payment method within 30 days of the service date will apply. i.e. credit card or wallet balance. All reward points received with the purchase will be removed from your account after the refund.

Duplicate or fraud purchases

If you suspect there was a duplicate or fraudulent purchase from your account, we may ask for supporting evidence before issuing a refund.

Copyright, Trademarks, and User License

Unless otherwise indicated, the Sites and all content and other materials therein, including, without limitation, the Splashes logo and all designs, text, graphics, pictures, information, data, software, sound files, other files and the selection and arrangement thereof (collectively, “Site Materials”) are the property of Splashes Wash Lodge Inc. or its licensors or users and are protected by Canadian and international copyright laws. Splashes, Splashes.ca, Splashes Auto Glass, and other Splashes trademarks, service marks, graphics, and logos used in connection with the Sites are trade names, trademarks or registered trademarks of Splashes Wash Lodge Inc. Other trademarks, service marks, graphics and logos used in connection with the Sites are the trademarks or registered trademarks of their respective owners (collectively “Third Party Marks”). The Splashes Marks and Third-Party Marks may not be copied, imitated, or used, in whole or in part, without the prior written permission of Splashes or the applicable trademark holder. The Sites and the Content are protected by copyright, trademark, patent, trade secret, international treaties, provincial and federal laws, and other proprietary rights and also may have security components that protect digital information only as authorized by Splashes or the owner of the Content. Third Party Content, Sites, Products and Services (including Adverstising and Promotions)

Splashes may provide third party content on the Sites (including embedded content) or links to third-party web pages, content, applications, products and services, including advertisements and promotions (collectively, “Third Party Content”) as a service to those interested in this information. We do not control, endorse or adopt any Third-Party Content, including that the inclusion of any link does not imply affiliation, endorsement or adoption by Splashes of any site or any information contained therein, and can make no guarantee as to its accuracy or completeness. You acknowledge and agree that Splashes is not responsible or liable in any manner for any Third-Party Content and undertakes no responsibility to update or review such Third-Party Content. You agree to use such Third-Party Content contained therein at your own risk. When you visit other sites via Third Party Content, or participate in promotions or business dealings with third parties, you should understand that our terms and policies no longer govern, and that the terms and policies of those third-party sites will now apply. Modification to the Sites

Splashes reserves the right to modify or discontinue, temporarily or permanently, the Sites or any features thereof without prior notice. You agree that Splashes will not be liable for any modification, suspension or discontinuance of the Sites or any part thereof.

Splashes reserves the right to change or modify these Terms or any other Splashes policies related to use of the Sites at any time and at its sole discretion by posting revisions on the Sites. Continued use of the Sites following such changes or modifications to the Terms or other Splashes policies will constitute acceptance of such changes or modifications.
